Terms & Conditions

These terms and conditions make up a binding agreement with Shakti Rose Pty Ltd trading as The Open Mind Space ABN 53 676 966 975 and you. By purchasing a membership or drop-in class you agree that you have read and agree to abide by these Terms and Conditions mentioned in this contract. These terms and conditions can be accepted by making payment for any of our services online or in the studio.

 

Drop In / Casual Pass

Payment

  • By purchasing a drop-in class you are agreeing to purchase for the agreed amount with the passes being valid for 7 days from the date of purchase.

  • There are no refunds for change of mind or errors in purchasing.

 

What you receive

  • One timetabled class attendance

 

Cancellations

  • Our class cancellation policy is set out below in these terms and conditions.

  • If you fail to cancel your class as set out in our cancellation policy, your class fee will be forfeited.

 

Intro Offer

Payment

  • By purchasing an Intro Offer you are agreeing to purchase for the agreed amount with the pass being valid for 14 days from the date of your first class.

  • There are no refunds for change of mind or errors in purchasing.

  • This pass can only be purchased once.

 

What you receive

  • 14 days unlimited timetabled class attendance

 

10 Class Pass Pack

Payment

  • By purchasing a 10 class pass pack you are agreeing to purchase for the agreed amount with the passes being valid for 3 months from the date of purchase.

  • There are no refunds for change of mind or errors in purchasing.

  • Class passes can only be used by one individual and are not able to be shared.

 

What you receive

  • Ten timetabled class attendances.

 

Cancellations

  • Our class cancellation policy is set out below in these terms and conditions.

 

If you fail to cancel your class as set out in our cancellation policy, your class fee will be forfeited.

 

Unlimited Studio & Online Membership

Payment

  • By purchasing an Unlimited Membership you are agreeing to purchase for the agreed amount, as an automatic charge to your credit/debit card each fortnight for a minimum contract period of a minimum 1 (one) fortnightly payment. You understand that membership payments will continue after the minimum term unless you specifically ask to cancel them in writing. By agreeing to this contract you certify that you are the holder of the credit/debit card used for these membership payments. 

 

What you receive

  • Unlimited timetabled class attendances and unlimited member benefits.

  • Unlimited access to online (on-demand) classes via Momence

  • Access to all timetabled classes

  • Experienced and passionate teachers

  • Special discounts on selected workshops and events

Student Unlimited Membership – Studio Access Only

Payment

  • By purchasing a Student Unlimited Membership you are agreeing to purchase for the agreed amount, as an automatic charge to your credit/debit card each fortnight for a minimum contract period of a minimum 1 (one) fortnightly payment. You understand that membership payments will continue after the minimum term unless you specifically ask to cancel them in writing. By agreeing to this contract you certify that you are the holder of the credit/debit card used for these membership payments. 

 

What you receive

  • Unlimited timetabled class attendances.

  • Access to all timetabled classes

  • Experienced and passionate teachers

  • Special discounts on selected workshops and events

Eligibility for Student Membership

Full-time Student Card Holders:

  • High School

  • Tafe

  • University

  • College

 

Unlimited Online Only Membership

​Payment

  • By purchasing an Unlimited Online Only Membership you are agreeing to purchase for the agreed amount, as an automatic charge to your credit/debit card each week. You understand that membership payments will continue unless you specifically ask to cancel them in writing or use the Momence platform to cancel the subscription yourself, which you can do any time. By agreeing to this contract you certify that you are the holder of the credit/debit card used for these membership payments. 

 

What you receive

Conditions of all Studio Memberships and attendance at The Open Mind Space

  • In order to attend a class with us you will need to sign-in at reception upon every visit prior to your class starting.

  • Your membership with us has exclusive use. If a Member allows his or her membership to be used by another person for the purpose of obtaining admission, the person to whom we have membership contract with will forfeit all claims and rights to the membership and ceases to be a Member at The Open Mind Space.

Class Cancellation Policy

  • Online booking opens 7 days prior to class.

  • Class sizes are limited, we strongly recommend you pre-book online, especially for popular or peak time classes.

  • If you are unable to attend your class you must cancel via the Momence booking system either online or in the app 1hr in advance to class start time.

  • No class credits will be returned if cancellation occurs within 1hr of class starting.

  • For drop-in/casual classes, no refunds will be given but you will receive a class credit if cancellation occurs at least 1hr prior to class start time.

  • To cancel your class – Please sign in to your dashboard or mobile app to cancel your booking as early as possible.

  • Cancellations will not be accepted via email or social media direct message (DM).

Waitlist

  • Please check your emails/the app up to 1hr prior to class start time to see if you made the class.

  • If you no longer wish to attend please cancel your place on the waitlist.

This policy is in place to ensure everyone has a chance to attend class. We appreciate your support!

 

Suspension of Membership

  • To suspend your Unlimited Studio & Online Membership a written request must be submitted to hello@theomspace.com.au at least 14 days in advance of your requested suspension start date.

  • The maximum suspension is 56 days. Once you have requested a suspension, you will be contacted via email notification to confirm your suspension. 

  • Please note: we are unable to suspend 10 class passes, unlimited online only memberships, backdate suspensions or suspend memberships ‘until further notice’. Suspensions can be made at any point during the billing cycle. Following the end of your requested suspension period, your weekly payments will automatically be reactivated. 

 

Cancellation of Unlimited Studio & Online Membership

Membership payments will continue after the minimum term of two weeks until further notice from you. All cancellation requests must be submitted in writing to hello@theomspace.com.au You may cancel your membership once outside the initial two week period. Once you have submitted your cancellation request, you will receive email notification that it has been accepted. If you do not receive this notification within 7 days of your cancellation request please contact us.

2 weeks notice in writing is required to cancel your membership. We require 14 days notice to process the request. Where possible your membership will cease the day prior to your next payment/cycle renewal. The exception being if your next renewal is within 24hrs of your notice to cancel.

Cancellation of Unlimited Online Only Membership

Payments will continue until you make a cancellation request in writing to hello@theomspace.com.au or you may cancel your online membership at any time via https://momence.com/sign-in?hostId=12909

Payment of Fees

The Open Mind Space has contracted Stripe BECS Direct Debit to provide direct debit services. 

 

Unsuccessful Payments

  • If there are insufficient funds for whatever reason at the time of the direct debit The Open Mind Space will continue to attempt to process your payment. Please note a direct debit rejection fee may be charged by your banking institution and we reserve the right to try for this payment until successful. You will be sent an automated email notification of each unsuccessful attempt. Membership Fees will continue to be debited from the Member’s chosen account until the Member, or The Open Mind Space, cancel the arrangement in line with the Cancellation of Membership clause of these Terms and Conditions.

  • If at any time the Member’s membership fees are overdue The Open Mind Space may terminate the membership or suspend booking privileges with immediate effect. 

  • To avoid additional charges or disruption to your service please contact The Open Mind Space and let us know if you require alternative payment arrangement or need to alter your payment schedule. 

 

Querying a Payment

If you have any questions around a payment or charge you can contact hello@theomspace.com.au  We will do our best to respond within 7 days. If you are not happy with our response, you may contact your financial institution.

   

Ongoing Concession Rate Eligibility

Members who are eligible for a concession rate for a drop in or 10 class pass must provide proof every twelve (12) months from joining date that they are eligible for a concession rate of membership. If you do not show your eligibility after the first 12 months of your membership your membership rate will be increased to the full rate.

 

Eligibility for Concession Rate:

  • Senior’s Card

  • Pensioner Concession Card

  • Full Time Student Card

  • Health Care Card (must cover the member, not just their dependants)

  

Staying Up-To-Date with Our Terms

It is the responsibility of the Member to inform The Open Mind Space of any changes to the Member’s personal details that are relevant to the Member’s Contract. We will notify you by placing a notice in the studios, publishing on our website or social media pages or speaking to you via phone or in the studio or writing you an email. 

 

Variations

We may sometimes add to or change our terms and conditions. This includes changing class times, teachers, opening and closing hours on public holidays, our services and facilities and membership fees. We do not reduce your membership fees because our studio is closed for renovations, a class is cancelled or for reduced schedule during public holidays. 

 

Membership Price Increase

Your membership price remains fixed while you are a current member. If you cancel your membership at any time, you will sign up to a membership at the prices valid at the time of re-signing as a member.

Liability and Risk

  • You agree that you will participate in any of the classes offered by The Open Mind Space at your own risk.

  • To the maximum extent permitted by law, we assume no liability or responsibility for accidents or injury to person or property that may result from our services.

  • Our total liability to you for any Loss arising out of or in connection with:

  1. any act, error, negligence, misrepresentation or omission concerning or arising out of Our services; and

  2. any breach of these terms and conditions or breach of duty of any kind owed in connection with the provision of the services;

is limited to and will not in any circumstances exceed the price paid for any of our services.

 

Nothing in this Agreement is intended to exclude or restrict any liability that cannot be excluded or restricted by law.

 

In this clause Loss means any and all loss (including pure financial loss), injury, liability, damage, compensation, claim, demand, expense, interest or cost, including reasonable legal fees, whether arising in contract or otherwise.

 

You should always consult a medical doctor before beginning any type of exercise program.

 

When attending The Open Mind Space I agree:

  • I will faithfully follow all instructions given to me by The Open Mind Space and its teachers as to when, where, and how to perform and not to perform the Yoga Exercises.

  • I understand and acknowledge that I am to receive instruction in Yoga Exercises and theory only. The Open Mind Space, its owners, teachers or employees are not liable for, nor expected to provide and advice, training or medical assistance other than in the form of the Yoga Exercises.

  • I consent to receive medical treatment, which may be deemed necessary in the event of injury, accident or illness.
